Blow to Apple: Samsung can sell Galaxy Nexus in the U.S.

An appeals court has overturned U.S. preliminary injunction on the sale of Samsung's Galaxy Nexus smartphone. The decision is a setback for Apple in its battle against Google.

In Samsung's headquarters today is because chewing joy. The appeals court reversed U.S. decision prohibiting selling Samsung Galaxy Nexus phone there. The move marks another new chapter in the legal battle that kept the South Korean company with the U.S., as the company had achieved the block last June that a California court prevented sell the smartphone Samsung for alleged patent violation of Apple.
The appeals court has ruled that the U.S. District Court in California "did abuse its discretion in issuing an injunction" and returned the case to a lower court for reconsideration California.
Samsung thereby achieved their second victory against Apple in just days, since early October also lifted the ban on sale of Samsung Galaxy Tab 10.1 tablet in the U.S.. The decision also has another winner, Google, as its Android operating system is the heart of many of the South Korean giant's mobile devices.
In a brief statement, Samsung welcomed the decision of the court of appeals of the United States, which in his opinion "confirms that the role of the patent law is to protect innovation instead of stifling competition and unfairly restrict consumer choice." The Asian company added that it will continue to take "all necessary measures" to ensure the availability of their products.
Apple and Samsung have many months fighting a legal battle in the courts of many countries for patent violation and design plagiarism on the devices. Both companies account for more than 50 lawsuits. The hardest decision against South Korea took place in late August when a U.S. court ruled that Samsung had infringed six patents of Apple and imposed a penalty of 1,000 million dollars (767 million euros).
The new victory achieved by Samsung, certainly important for the company, will not, however, a great impact on the smartphone market, as the phone model in the case concerned, the Nexus is an old product South Korean company.
However, Apple's stock fell nearly 2% after news last night (Spanish local time), as the decision of the Court of Appeals U.S. is a slap for this company, as in the case of patents Nexus ( involving the functions that enable software) are directly related to the functions of Android, the software that powers most of the world's smartphones, and could hinder other lawsuits, according to Reuters.
In fact, on Wednesday, Google CEO Eric Schmidt said the company fought its battle with Apple "is defining the current mobile industry" and called the fight between the two companies as "the final battle". "I've never seen a rivalry of platforms on this scale," he said in an interview with All Things Digital, the technology blog of The Wall Street Journal. The manager of Google also mentioned in that interview to the patent war and said he does not believe that these clashes in the courts benefit anyone. Schmidt said that the worst that will stand throughout this fight will not be the tech giants that could shield but small technology companies. "I think that ultimately, bad for innovation," he said ..
